La vidéo montre clairement l’homme en question déjà menotté et neutralisé par les agents de sécurité. Il ne représente plus aucune menace immédiate. Malgré cela, Me Eno Zéphirin s’approche, lui porte des coups et le gifle devant les caméras, avant de le placer en garde à vue. Ce geste, souligne le RHAJAC, constitue un abus manifeste de pouvoir et une violation grave des principes fondamentaux de la justice.
Pour l’organisation, il n’existe aucune situation de légitime défense pouvant justifier ces actes. Au contraire, l’intervention du magistrat s’apparente à une substitution de la justice par sa propre autorité.
Une exigence de responsabilité
Face à ce qu’il considère comme une atteinte grave à l’État de droit, le RHAJAC demande non seulement la révocation immédiate de Me Eno Zéphirin, mais également l’ouverture de poursuites judiciaires à son encontre. L’organisation réclame aussi le dédommagement intégral de la victime, pour les préjudices physiques, moraux et matériels subis.
Dans sa note, le RHAJAC rappelle qu’aucun acteur, même judiciaire, n’est au-dessus de la loi, et que tolérer de tels comportements reviendrait à renforcer l’impunité et l’arbitraire dans le pays.
L’impératif d’une justice crédible
Au-delà de cet incident, cette affaire soulève une question plus large : comment garantir la confiance des citoyens envers les institutions judiciaires lorsqu’un magistrat lui-même semble franchir les limites légales ?
