Au Cap-Haïtien, le boulevard de Carénage est devenu le théâtre d’un incident qui continue de faire réagir la population et les acteurs de la société civile. Le vendredi 9 janvier 2026, un commissaire du gouvernement, Me Eno Zéphirin, est au centre d’une polémique après avoir frappé et giflé un individu déjà maîtrisé par ses agents de sécurité. Une vidéo de l’événement, largement partagée sur les réseaux sociaux, a rapidement suscité indignation et interrogations sur le respect des règles de droit dans la ville.
Le Réseau Haïtien des Journalistes Anti-Corruption (RHAJAC) n’a pas tardé à réagir. Dans une note d’alerte publiée ce 11 janvier 2025, l’organisation exige la révocation immédiate du magistrat, dénonçant un acte « en violation flagrante de la loi et des principes fondamentaux de l’État de droit ».
Un contexte tendu
Depuis plusieurs semaines, la délégation départementale du Nord mène une opération de démolition d’entreprises jugées non conformes aux normes légales. Cette campagne a créé un climat de tension entre les autorités et certains commerçants, confrontés à la fermeture ou à la destruction de leurs locaux.
C’est dans ce contexte de contrôle strict que l’incident du boulevard de Carénage s’est produit. Le magistrat affirme avoir été agressé, mais les images montrent un tout autre scénario.
La scène qui choque
La vidéo montre clairement l’homme en question déjà menotté et neutralisé par les agents de sécurité. Il ne représente plus aucune menace immédiate. Malgré cela, Me Eno Zéphirin s’approche, lui porte des coups et le gifle devant les caméras, avant de le placer en garde à vue. Ce geste, souligne le RHAJAC, constitue un abus manifeste de pouvoir et une violation grave des principes fondamentaux de la justice.
Pour l’organisation, il n’existe aucune situation de légitime défense pouvant justifier ces actes. Au contraire, l’intervention du magistrat s’apparente à une substitution de la justice par sa propre autorité.
Une exigence de responsabilité
Face à ce qu’il considère comme une atteinte grave à l’État de droit, le RHAJAC demande non seulement la révocation immédiate de Me Eno Zéphirin, mais également l’ouverture de poursuites judiciaires à son encontre. L’organisation réclame aussi le dédommagement intégral de la victime, pour les préjudices physiques, moraux et matériels subis.
Dans sa note, le RHAJAC rappelle qu’aucun acteur, même judiciaire, n’est au-dessus de la loi, et que tolérer de tels comportements reviendrait à renforcer l’impunité et l’arbitraire dans le pays.
L’impératif d’une justice crédible
Au-delà de cet incident, cette affaire soulève une question plus large : comment garantir la confiance des citoyens envers les institutions judiciaires lorsqu’un magistrat lui-même semble franchir les limites légales ?
Pour le RHAJAC, la réponse est claire : la justice doit se tenir à ses propres règles, sans privilège ni exception. La réaction des autorités compétentes dans les jours à venir sera scrutée avec attention par la société civile et la population, car elle pourrait définir le niveau de tolérance face à l’abus de pouvoir dans le pays.
